The Financial markets Authority (FMA) is a New Zealand government agency responsible for enforcing securities, financial reporting and company law as they apply to financial services and securities markets. The FMA also regulates securities exchanges, financial advisers and brokers, auditors, trustees and issuers - including issuers of KiwiSaver and superannuation schemes. It jointly oversees designated settlement systems in New Zealand, with the Reserve Bank of New Zealand (RBNZ). FMA is a member of New Zealand’s Council of Financial Regulators.

We are concerned that Bay Exchange is providing financial services to New Zealand residents without complying with the New Zealand financial markets legislation. Bay Exchange is not a registered on the Financial Service Providers Register to provide their services in New Zealand.
We are aware that a New Zealand resident has been unable to access their Bay Exchange trading account after a payment has been made to them. The person is no longer able to contact their account manager and broker at Bay Exchange.
We recommend that investors exercise caution when dealing with Bay Exchange.
